Seaview man freed of murder

Failure of the Crown to exhibit sufficient evidence against a man charged with three counts of murder and arson resulted in him being freed yesterday.

Rohan Samuels of a Seaview Gardens address in St Andrew was charged with the murders of Rodex Fearon, 11; Norma Richards, 50 and 68-year-old Cynthia Johnson who was visiting from Clarendon.

Attorney-at-law Peter Champagnie made a successful application for a dismissal of the case against his client. He told the court for the court to prove a case against his client it would require more than just the caution statement that he had given when he was arrested.

Resident Magistrate Ann-Marie Nembhard after inquiring if there was anymore evidence against the accused made an order that there was not enough for a preliminary inquiry therefore Samuels should be freed.

When Samuels appeared in the Spanish Town Resident Magistrate's Court he was in custody for 15 months without bail.

Allegations before the court are that on May 17, 2009, about 11:30 p.m., Samuels along with other men went to St John's Road, St Catherine.

The group started to fire shots on a house and then doused it with gasolene.

It was then reportedly lit by the men. Johnson, Richards and Fearon were all killed in the incident.

Samuels was later held by investigators. He was subsequently charged and brought before the court on June 16, 2009.
